Asbetos Mesothelioma Death Lawsuits: Mesothelioma Deaths ...

Asbestos Mesothelioma Death Lawsuits Can Arise Out of Dangerous Products or Dangerous Conditions by Texas Asbestos Mesothelioma Death Lawyer Jason S. Coomer ?

Asbestos mesothelioma death lawsuits commonly arise out of defective products or dangerous conditions that have caused asbestos exposure.? Persons that have been diagnosed with mesothelioma or families that have lost a loved one from mesothelioma should investigate the source of the exposure to ensure nobody will be exposed in the future.?

It is also often helpful to contact an asbestos mesothelioma death lawyer to determine if they may have a viable lawsuit including a product dumping case, dangerous condition case, or defective product case for the exposure resulting in mesothelioma and loss of a loved one.

Mesothelioma Is Caused By Exposure To Asbestos and Unlike Lung Cancer, There Is No Association Between Mesothelioma and Smoking

Mesothelioma is a form of cancer caused by asbestos exposure in which malignant (cancerous) cells are found in the mesothelium.?? The mesothelium is a membrane that covers and protects most of the internal organs of the body. It is composed of two layers of cells: One layer immediately surrounds the organ; the other forms a sac around it. The mesothelium produces a lubricating fluid that is released between these layers, allowing moving organs.?

Mesothelioma (cancer of the mesothelium) is a disease in which cells of the mesothelium become abnormal and divide without control or order. They can invade and damage nearby tissues and organs. Cancer cells can also metastasize (spread) from their original site to other parts of the body. Most cases of mesothelioma begin in the pleura or peritoneum. The pleura is the outer lining of the lungs and chest cavity.? Mesothelioma may also occur in the peritoneum (the lining of the abdominal cavity), the pericardium (a sac that surrounds the heart), or the layer surrounding reproductive organs.

Most people who develop mesothelioma have inhaled asbestos particles either through occupational exposure or have been exposed to asbestos dust and fibre in other ways, such as by washing the clothes of a family member who worked with asbestos, or by home renovation using asbestos cement products. Unlike lung cancer, there is no association between mesothelioma and smoking.

Mesothelioma is a relatively rare form of cancer, but reported incidence rates have increased in the past 20 years. Incidence of malignant mesothelioma currently ranges from about 7 to 40 per 1,000,000 in industrialized Western nations, depending on the amount of asbestos products used in the society.? The incidence is expected to continue increase in many parts of the world as asbestos products become more common. Mesothelioma occurs more often in men than in women and risk increases with age, but this disease can appear in either men or women at any age.

In the United States between 1939 and 1980, approximately 30 million people were occupationally exposed to asbestos in the United States. Between 1970 and 1990, there was a large increase in the diagnosis of pleural mesothelioma in asbestos workers and their families. Though many asbestos exposure mesothelioma cases have been misdiagnosed as adenocarcinoma of the lung or other diseases, it is clear that the incidence of mesothelioma increases with use of asbestos products.

In addition to mesothelioma, exposure to asbestos increases the risk of lung cancer, asbestosis (a noncancerous, chronic lung ailment), and other cancers, such as those of the larynx and kidney.

Symptoms of Mesothelioma

Symptoms of mesothelioma can appear 20 to 50 years after exposure to asbestos. These symptoms include shortness of breath, chronic cough, coughing up blood, night sweats, and pain in the chest due to an accumulation of fluid in the pleural space are often symptoms of pleural mesothelioma.? Symptoms of peritoneal mesothelioma include weight loss and cachexia, abdominal swelling and pain due to ascites (a buildup of fluid in the abdominal cavity). Other symptoms of peritoneal mesothelioma may include bowel obstruction, blood clotting abnormalities, anemia, and fever. If the cancer has spread beyond the mesothelium to other parts of the body, symptoms may include pain, trouble swallowing, or swelling of the neck or face.

Mesothelioma can affect several areas of the body and can cause the following symptoms:

  • chest wall pain

  • pleural effusion, or fluid surrounding the lung

  • shortness of breath

  • fatigue or anemia

  • wheezing, hoarseness, or cough

  • blood in the sputum (fluid) coughed up

  • abdominal pain

  • ascites, or an abnormal buildup of fluid in the abdomen

  • a mass in the abdomen

  • problems with bowel function

  • weight loss

  • blood clots in the veins, which may cause thrombophlebitis

  • disseminated intravascular coagulation, a disorder causing severe bleeding in many body organs

  • jaundice, or yellowing of the eyes and skin

  • low blood sugar level

  • pleural effusion

  • pulmonary emboli, or blood clots in the arteries of the lungs

  • severe ascites

Shortness of breath and pain in the chest from accumulation of fluid in the pleura are often symptoms of pleural mesothelioma. Symptoms of peritoneal mesothelioma include weight loss and abdominal pain and swelling due to a buildup of fluid in the abdomen. Other symptoms of peritoneal mesothelioma may include bowel obstruction, blood clotting abnormalities, anemia, and fever. If the mesothelioma cancer has spread beyond the mesothelium to other parts of the body, symptoms may include pain, trouble swallowing, or swelling of the neck or face.

Many of the above symptoms may be caused by mesothelioma or by other, less serious conditions. It is important to see a doctor about any of these symptoms. Only a doctor can make a diagnosis.?

Grand Canyon University lands free Mass. Christian campus

by Jay Lindsay, Associated Press

BOSTON (AP) -- The owners of an historic campus in the hills of western Massachusetts announced Friday that they'll give it away to a Christian college from Arizona that plans to eventually host 5,000 students there.

The Northfield campus will be a new home for Grand Canyon University, the first for-profit Christian school in the country.

Grand Canyon was the choice after the other finalist, the North American Missions Board of the Southern Baptist Convention, backed out of the running.

The two were the last standing after more than 100 organizations, from culinary schools to TV ministries, expressed interest in the free 217-acre property along the Connecticut River, which its owners value at about $20 million.

In the end, Grand Canyon's financial strength, growth and vibrant Christian life made it a great choice, said Steve Green, president of the Oklahoma City-based Hobby Lobby craft store chain, whose family owns the campus.

"We are excited about the opportunity to see Grand Canyon bring it to life," Green said.

The family hopes to close the deal by year's end, he said.

The campus once housed the Northfield Mount Herman prep school, founded by 19th-century evangelist D.L. Moody. The Greens bought it in 2009 and later offered to give it away to group that would honor Moody's commitment to traditional Christian teachings.

Grand Canyon University, based in Phoenix, has about 7,000 traditional students and 40,000 online students. With a base in the Northeast, Grand Canyon chief executive Brian Mueller said he thinks the online number can grow by 8 percent annually.

The school expects to spend $100 million to $150 million on infrastructure and other improvements in Northfield, with students arriving starting in 2014. The buildup to 5,000 students and full academic, athletic and arts programs will take place over several years and with full consultation with the community, he said.

"We want to build on what's there," Mueller said. "It's historic. It's beautiful."

The plan promises economic development, but there's uncertainty about the impact in Northfield, with a population just under 1,100. Residents have expressed concerns about the potentially restrictive beliefs of the new institution and the effects on their school system and even on the town's survival.

Corinne Allen, owner of Rooster's Bistro on Main Street, said some residents will undoubtedly be disappointed to lose "the Norman Rockwell-y feel of our small country town." But she said she was elated by Grand Canyon's pending arrival, citing benefits such as increased property values, more visitors and more business.

"I feel as though the town is sinking. This is going to save us," she said. "There's far more advantages than disadvantages."

The campus was built in 1879 and abandoned by the prep school, which consolidated at another nearby campus, in 2005. The school left behind a collection of dignified but deteriorating buildings and $1 million in annual utility costs.

The Greens spent $5 million on upgrades and repairs, intending to give it to a new college named for Christian scholar C.S. Lewis. But that project ran into financing problems in December, and the Greens made their unique offer.

Despite the broad interest, the number of organizations capable and willing to assume the steep costs of running the campus was relatively small. The Southern Baptist mission board, which proposed running the campus as a missionary training and pastoral retreat center, said Friday it decided the campus wasn't for it "after closely evaluating the potential uses, logistics and operating expenses."

Grand Canyon University was founded in 1949 as a private Christian university and was saved from bankruptcy in 2005 by a group of Christian investors.

Mueller said the school aims to provide a private Christian college education at an affordable cost, which is kept low in part by funds from its large online enrollment and investment in the publicly traded company. Tuition is $16,500, roughly half the average $32,617 tuition at a private four-year college, according to the National Center for Educational Statistics.

The business model has worked, as growth in its traditional and online student body has been exponential. But Green said it's important that, before the deal closes, the school shows how it intended to keep its Christian heritage central to its mission.

Mueller said the school's approach is to make its Christian identity a main but voluntary part of campus life in the hope people are attracted to what they see. It has worked to build a strong Christian community in Phoenix, and he said he believes it will work in Northfield.

"We are anxious for the opportunity," he said. "We are anxious to take it on."

Apple Quickly Released These 4 iPhone 5 Ads - Business Insider

As if the hoards of people camping out to get the iPhone 5 wasn't good publicity enough, Apple rolled out four brand new iPhone 5 ads in quick succession Friday night. And they're good.

It's about time considering that for a while, the only iPhone 5 related spots we were seeing were viral jabs by Samsung.

While we already showed you the first spot, called?"Thumbs," late last night?, there are three others that follow a similar format ? clean and compelling, the ads have one word titles that focus on a cool new feature. (Apple is probably holding off on the "Maps" spot until a future update).?

Oh, and they're all narrated by Newsroom (and Dumb and Dumber) star Jeff Daniels.

Watch all the upbeat spots, by?TBWA/Media Arts Lab, below.

"EARS" ("I don't know what shape that is, but it's not round.")

"CHEESE"

"PHYSICS"

AND IN CASE YOU MISSED IT, "THUMBS"

BlackBerry outage in Europe and Africa

FILE - In a Thursday June 21, 2012 file photo, Tim Neil, Research In Motion Ltd.'s Canadian Operating Director of Operations, Platforms and Tools, speaks about the Blackberry 10 architecture during the RIM Blackberry 10 Jam World Tour in Toronto. Struggling BlackBerry-maker Research in Motion said Friday, Sept. 21, 2012 it resolved an outage affecting users in Europe, Middle East and Africa that had interrupted service for customers on the very day Apple Inc. unveiled its new iPhone 5. (AP) ? The chief executive of struggling BlackBerry-maker Research In Motion apologized Friday after an outage in Europe and Africa interrupted service for customers on the very day Apple Inc. released its new iPhone 5.

RIM announced the issues in postings on Facebook and Twitter on Friday, and later said it resolved the issue. The service disruption lasted up to three hours for some BlackBerry users.

The outage brought up unpleasant memories of last year's troubles with emails and chat messages that left many users bereft for up to three days.

The timing could not have been worse, coming as lines formed outside of Apple stores in a number of cities as the new iPhone 5 went on sale.

RIM shares plunged 6.5 percent, or 45 cents, to $6.45 in trading on the Nasdaq.

Chief Executive Thorsten Heins said up to six percent of RIM's users may have been affected. He said the company is conducting a full analysis and will report back. No reason for the outage was given.

"I want to apologize to those BlackBerry customers in Europe and Africa who experienced an impact in their quality of service earlier this morning. The BlackBerry service is now fully restored and I can report that no data or messages were lost," Heins said in a statement posted on RIM's website. "Preliminary analysis suggests that those customers may have experienced a maximum delay of 3 hours in the delivery and reception of their messages."

RIM initially said the outage included the Middle East, but RIM spokeswoman Amy Jones later said it did not.

"It's the worst timing," Jefferies analyst Peter Misek said. "This is bad publicity and it's very unfortunate. But frankly the attention is all going to be on Apple today, all the weekend ?and frankly until the end of the year. Frankly, it's kind of irrelevant. The only thing that's relevant is when they are going to come out with their new phones."

Misek said he thinks the transition to the BlackBerry 10 software intended to run their new line of smartphones, could be a cause of the outage. RIM is preparing to launch the new phones early next year, after a series of delays.

"We think that switch over is causing the difficulties," Misek said.

The latest outage comes as customers are abandoning their BlackBerrys for flashier iPhones and Android phones.

RIM is facing its most difficult period in its history. The Waterloo, Ontario-based company is laying off thousands this year as it transitions to new software platform that has been deemed critical to its survival.

Colin Gillis, an analyst with BGC Financial, called it ironic that an outage would happen that the day Apple is releasing the iPhone 5. Gillis noted that RIM is trying to get its operating centers ready for the new BlackBerrys at the same time that it's laying off thousands and turning over senior management in a time of crisis.

"Systems are going to break when you are in that kind of mode. It's the worst possible environment to try and launch a critical, make or break product," Gillis said.

RIM was once Canada's most valuable company with a market value of more than $80 billion in June 2008, but the stock has plummeted since, from over $140 share to less than $7. RIM's decline is evoking memories of Nortel, another Canadian tech giant, which declared bankruptcy in 2009.

Behind closed doors, Romney gossips, imitates Kissinger

WASHINGTON (Reuters) - The surreptitious video recording of a fundraiser held for Republican Mitt Romney in May provided a rare glimpse of how he views supporters of President Barack Obama - as government dependents.

It also provided an equally novel sight of a relaxed Romney doing an impression of Henry Kissinger, dishing about late-night television talk show host David Letterman, and receiving some pointed tips for his presidential campaign.

"I saw Dr. Kissinger," Romney says on the video, recounting a meeting in New York with the former U.S. secretary of state. "I said to him, 'How are we perceived around the world?' And he said one word: 'Veak!'"

The secretly filmed recording, released in its entirety by the liberal Mother Jones magazine on Tuesday, opened a window on how Romney acts during the kind of private meeting with donors that is helping to propel the most expensive presidential campaign in U.S. history.

In this case the former Massachusetts governor and private equity executive was speaking to donors who paid $50,000 each for the privilege of his company at a private dinner at the Boca Raton, Florida, home of financier Marc Leder.

Family and friends often say that Romney, who can be awkward while campaigning, is at ease and funny when the cameras are off? or believed to be.

"You're not eating," Romney scolded one attendee during his remarks at the fundraiser.

"I'm mesmerized," the donor said.

"He's bored to tears," Romney said to laughter.

At one point, Romney decided to give the donor a lesson in eating.

"You take this, your fork, and you put it in," Romney said.

When asked about Democrats' criticisms of his tenure as a wealthy executive at Bain Capital, Romney pretended to plead poverty.

"I'm poor as a church mouse," said Romney, who has an estimated fortune of $250 million.

NOT UP FOR 'SLAPSTICK'

Romney also gossiped about CBS late-night talk show host David Letterman, a frequent critic of the Republican. Romney said he preferred Jay Leno, host of NBC's "The Tonight Show with Jay Leno."

"Letterman hates me because I've been on Leno more than him. They are very jealous of each other, you know," Romney said.

By coincidence, a few hours after the video's release online, Obama arrived in New York City to tape an interview with Letterman.

Romney said he turned down an appearance on NBC's "Saturday Night Live" because visiting the show "has the potential of looking slapstick and not presidential."

Days before the election in 2008, Republican presidential candidate John McCain and his running mate, Sarah Palin, flew to New York to be on the show.

'HISPANICS DO NOT WANT TO VOTE FOR YOU'

At the Florida fundraiser, Romney's comments were captured by a videocamera that had been placed on what appeared to be a marble bar.

Waiters wearing white gloves were seen serving the guests red wine from decanters. For most of the video, only the backs of donors' heads can be seen, with Romney in profile.

The audio does, however, pick up donors' comments to Romney, including some good-natured ribbing about his image on the campaign trail.

"They say, 'He's a rich boy,'" one donor affably told Romney during the dinner.

The comments reflected donors' anxieties about Romney's perceived deficiencies.

One donor complained of the difficulties of converting Obama supporters to Romney's side.

"Right now I'm very concerned," she said. "Women do not want to vote for you. Hispanics, majority, do not want to vote for you. College students don't."

"Why don't you stick up for yourself?" a male donor asked Romney.

"You have to show your face more on TV," said another.

A third donor counseled Romney on the importance of social media.

A fourth donor urged Romney to "take the gloves off and talk to the people who actually read the paper."

When Romney responded to their reservations by telling the guests about the importance of his three debates against Obama in October, a donor cut him off.

"You will do so well," the donor said. "Your debates are incredible."
